Part B: Website terms of use
B1. Using this website
By using www.hybridenergyltd.co.uk and quote.hybridenergyltd.co.uk (together, "our website"), you agree to these website terms. If you do not agree, please do not use our website.
B2. Information on our website
We work hard to keep our website accurate and up to date, but the content is general information only. It is not a substitute for a survey of your property or for the written proposal and quotation we give you before you sign a contract. Prices, products, and availability shown on the website may change.
Any generation, savings or payback figures on the website, including those shown by our online quote tool, are estimates based on stated assumptions. They are not a guarantee and do not form part of a contract. Your formal performance estimate will be given to you in writing, before you sign, as described in section C4.
B3. Our online quote tool
The quote tool at quote.hybridenergyltd.co.uk is powered by Simplified Energy. It uses satellite imagery and the information you enter to produce an indicative design and price. A quote from the tool is an invitation to discuss your project, not a binding offer. Before you commit, one of our designers will check that the system is right for your property and give you a full written proposal and quotation. If you accept a quote, sign or pay a deposit through the tool, the cancellation rights and pre-contract information in Part C still apply, and you will be shown the cancellation notice and form before you commit.
B4. Intellectual property
The content of our website, including text, images, logos and designs, belongs to us or our licensors. You may view and print pages for your own personal use. You may not copy, reproduce or use our content for commercial purposes without our written permission. The RECC, MCS, NICEIC, Trustpilot and other logos belong to their owners and are shown with permission.
B5. Acceptable use
You must not misuse our website. This includes trying to gain unauthorised access, introducing viruses or harmful code, or using automated tools to scrape content. Please only enter information about yourself or a property you are authorised to deal with.
B6. Links to other websites
Our website links to other websites, such as RECC, MCS and manufacturers. We are not responsible for their content or availability.
B7. Our responsibility for the website
We do not guarantee that our website will always be available or free from errors. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded by law. Your statutory rights as a consumer are not affected.
B8. Privacy and cookies
We are registered with the Information Commissioner's Office (ICO) as a data controller, registration number ZB463156. How we use your personal information is explained in our Privacy Policy at www.hybridenergyltd.co.uk/privacy-policy, and our use of cookies in our Cookie Policy (when published on our website).
Part C: Summary of our terms for domestic customers
This part applies if you are a consumer: an individual buying for purposes wholly or mainly outside your trade, business or profession. It summarises the main points of our contract. The full terms that apply to your project are the ones in your written quotation and contract. If anything on this page is different from your contract, your contract applies, but nothing in either document reduces your legal rights.
C1. Our commitments under the Renewable Energy Consumer Code
As a RECC member we follow the Consumer Code, which covers how we advertise, the information we give you before you sign, our quotations, deposits, contracts, guarantees and after-sales service. You can read the Code at www.recc.org.uk. We will give you a leaflet describing the Code before you sign.
In particular we will:
- never use high-pressure sales techniques, such as "sign today" discounts, inflated prices followed by discounts, or false claims about limited availability;
- give you clear information in plain English, and give you time to read and understand it before you sign;
- suggest that you involve a trusted friend or relative if that would help you, and adapt how we work if you have additional needs; and
- deal with any problem quickly, politely and fairly.
C2. Information before you sign
Before you sign a contract, we will give you in writing:
- our business details (as in Part A), including our MCS certification and the professional bodies we belong to;
- a proposal describing the system, how it works and any side effects, such as noise from inverters or batteries;
- a performance estimate (see C4);
- any savings or payback estimates, based on your actual energy use, with every assumption explained and its source given;
- a written quotation (see C3);
- the permissions and approvals that may be needed, such as planning permission, building regulations and network operator (DNO) notification under G98 or G99, and who will obtain each one;
- details of grants or incentives that may be available, and who is responsible for applying;
- your cancellation rights and a cancellation form;
- if finance options are shown, the information in Part D about our status and the lenders;
- details of our guarantees, warranties and aftercare, including any servicing the system will need and its likely cost;
- how to contact us quickly with questions, and how to complain and use the independent dispute resolution service; and
- the law that applies to the contract (see C14).
If you are a leaseholder, or have a mortgage, a freeholder or home insurers, you should tell them about the planned work and get any consent you need.
C3. Quotations
Our written quotations are signed by an authorised member of our team and follow a "no surprises" pricing policy. Each quotation will show:
- an itemised list of the equipment we will supply, including any batteries, EV charger or other related products;
- the price of the equipment and the price of the services, shown separately, including VAT and any required safety checks;
- the survey, design, installation and other services included;
- anything not included that you will need to provide or arrange;
- any site conditions that could lead to extra chargeable work, and the hourly or daily rate that would apply;
- any metering or monitoring you would need to pay for;
- the timetable and expected completion date;
- the payment method and timetable, and how long the quotation is valid for; and
- the performance estimate.
Your final invoice will not include anything unexpected unless you agreed to it in writing first.
Our quotations are normally valid for 30 days from the date of the quotation, unless we state a different period in writing.
C4. Performance estimates
Before you sign, we will give you a written performance estimate prepared using the method set out in the relevant MCS Installer Standard, specific to your property. It will show expected output in kilowatt hours (kWh) per year and explain the assumptions behind it. If you are having a battery or other related product installed, we will show how it is likely to affect the system's performance.
Solar output depends on the weather, shading and how you use electricity. A performance estimate is a guide, not a guarantee. We keep a record of the calculations we give you for 10 years after installation, as RECC requires.
If we have not yet carried out a technical survey when you sign, we will tell you. The design and performance estimate may change after the survey. If it changes, you can cancel without penalty.
C5. Surveys and design
We will carry out a technical survey of your property, normally after you accept a quotation and before work starts. Technical surveys are free of charge.
Before installation, we will give you a final design showing where the main equipment will go and any changes to your property or electrics. You must approve this design. If the final system differs from the quotation, we will tell you in writing. If it is no longer suitable for you, you may cancel and we will refund your deposit and any advance payment in full.
If, after the survey, we find that your property is not suitable, we will explain why in writing, cancel the contract and refund any money you have paid in full.
C6. Your right to cancel
14-day cooling-off period. In line with the Renewable Energy Consumer Code and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a cooling-off period of 14 days, starting on the day after you sign the contract or accept our quotation. During this period you may cancel the contract without giving any reason and without penalty. Where your contract is an off-premises or distance contract mainly for goods under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the statutory cooling-off period runs for 14 days from the day after the last goods are delivered. In all other cases under the Code, you have at least 14 days from the day after you sign. We will tell you which applies in your written contract and cancellation notice.
If we fail to give you the required cancellation information, your cancellation period may be extended by up to 12 months.
No work during the cooling-off period. We will not start any work on site, or deliver equipment for installation, during the 14-day cooling-off period unless you expressly ask us to in writing and confirm that you understand the effect on your cancellation rights. If you ask us to start early and then cancel within the cooling-off period, you will need to pay us a reasonable amount, in proportion to the work and equipment we have supplied up to the time you tell us that you wish to cancel. We will give you an itemised statement of that amount.
How to cancel: tell us clearly that you want to cancel, by email to info@hybridenergyltd.co.uk, by post to Unit C26, Lays Farm Trading Estate, Charlton Road, Keynsham, Bristol BS31 2SE, or using the cancellation form we give you with your contract. You do not have to use the form.
Refunds: if you cancel within the cooling-off period, we will refund all money you have paid, less any amount due for work you asked us to start early, within 14 days of the day you tell us you wish to cancel. We will refund you using the same payment method you used, unless you agree otherwise. If you used a finance agreement, cancelling your installation contract may also cancel, or allow you to withdraw from, the linked finance agreement. Please contact the lender as well.
Cancelling after the cooling-off period. You may still cancel your contract at any time after the cooling-off period has ended, by telling us in the same way. If you do, we may ask you to pay the reasonable costs and expenses we have already incurred in preparing for or carrying out your installation and cannot reasonably recover or avoid. For example, this may include:
- the cost of scaffolding already erected, or booked and not cancellable;
- restocking or return charges from our suppliers for equipment and materials already ordered or delivered;
- the reasonable cost of design, survey and network operator (DNO) application work already completed.
We will give you an itemised statement of any costs we deduct, and we will keep these to the minimum reasonably possible. We will not charge for sales or marketing costs incurred before you signed, and we will refund any balance of your deposit or advance payments that exceeds these costs.
C7. Deposits and advance payments
- Any deposit we ask for when you sign will be a reasonable percentage of the total price. RECC uses 15% as an example and never more than 25%. Our standard deposit is 20% of the total price.
- We may ask for a further advance payment, but no earlier than 3 weeks before the agreed delivery date of all the equipment. The deposit and any advance payments together will never be more than 60% of the total price.
- We only use your deposit and advance payments for work under your contract, for example to buy your equipment.
- Deposit protection: your deposit and any advance payment are insured with Independent Warranty Association (IWA) (www.iwa.biz). IWA can protect deposits of up to 25% of the contracted work (our standard deposit is 20%). If we stop trading before your contract is completed, the insurance means your contract can be completed by another RECC member at no extra cost to you, or your money is protected according to the policy terms. We will give you the policy details.
- If we buy equipment for your installation using your money and it is delivered to us, we hold it on trust for you, store it separately and insure it. Ownership of that equipment, or the part of it you have paid for, passes to you.
C8. Payment terms
Payment schedule: you pay a 20% deposit on acceptance of the quotation, and the balance on commissioning of the installed equipment. We accept payment by bank transfer and by card through a third-party card payment provider. Payment is due as set out on your invoice.
We will not hold back your handover documents, including your MCS certificate, until you have paid in full. RECC requires us to hand them over promptly after commissioning.
If you pay using a finance agreement, the terms of that agreement will be set out separately by the lender, and any savings or payback figures we give you will take the repayments and the total amount payable into account. Please see Part D: Paying with finance.
C9. Timetable
We will agree a timetable with you and include it in your contract. If we cannot give an exact date, we will give you a window of two or three days. We will tell you as soon as possible if dates need to change, and agree a new date with you.
If we make a significant change to the agreed timetable, other than because of events outside our control, you may cancel and receive a full refund of your deposit and any advance payment. If a delay is caused by something you are responsible for, such as an approval you agreed to obtain, we will do our best to arrange a new date that suits us both.
C10. Your responsibilities
To help the installation go smoothly, please:
- give us accurate information about your property and electricity supply;
- give us safe access to your property, roof space, consumer unit and meter on the agreed dates;
- obtain any permissions or consents that the contract says are your responsibility; and
- follow the operating and maintenance instructions we give you at handover.
C11. Installation, testing and handover
Our own trained, in-house teams carry out installations. If any part of the work is subcontracted, we will tell you who the subcontractor is and we remain responsible to you. We only use MCS-certified products.
When the work is finished, we will test and commission the system to MCS standards and give you a handover pack. It includes the commissioning record, MCS certificate, electrical certificates, operating and maintenance instructions, a description of the system, and details of all guarantees and warranties.
We will notify your network operator under G98 or apply under G99 as needed, and register the installation with MCS.
C12. Guarantees and warranties
- Your legal rights: under the Consumer Rights Act 2015, the goods we supply must be of satisfactory quality, fit for purpose and as described, and our services must be carried out with reasonable care and skill. Our guarantees are in addition to these rights.
- Manufacturer guarantees: the equipment comes with manufacturer guarantees against manufacturing faults, at no extra cost. The terms and periods for each product will be explained in your quotation and handover pack.
- Workmanship warranty: we guarantee our installation work for 10 years (above the RECC minimum of 2 years) at no extra cost. It transfers to the new owner if you sell your home.
- Insurance-backed protection: our workmanship warranty is backed by insurance with Independent Warranty Association (IWA) (www.iwa.biz), so it will be honoured for its full term even if we stop trading. IWA's standard insurance-backed guarantee cover is for up to 10 years (MCS financial protections are available from 6 years). When your policy is issued, please read it carefully; contact IWA within 14 days of receiving the policy if you have questions. Claims while we are trading should come to us first; if we have stopped trading, contact IWA using the details on your policy (www.iwa.biz).
- Extended warranties or service plans are optional. If we offer one, we will tell you who provides it, what it costs and what it covers.
C13. Aftercare, servicing and repairs
If you have a question or problem after installation, call us on 0117 427 0206 or email info@hybridenergyltd.co.uk. Before carrying out any repair or service work not covered by a guarantee, we will give you a written quotation and agree the price with you first.
C14. Our liability, law and disputes
We are responsible for loss or damage you suffer that is a foreseeable result of us breaking the contract or failing to use reasonable care and skill. We do not exclude or limit liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, or for fraud.
If you have a complaint, please follow our Complaints Procedure at www.hybridenergyltd.co.uk/complaint-policy. If we cannot resolve it, you can refer it free of charge to Green Homes Dispute Resolution, the independent dispute resolution provider appointed by RECC. We will not take court action against you without first trying to resolve the dispute through this process.
These terms and our contracts with you are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
C15. EV Charge Points
Where an EV charge point is supplied as part of a Solar PV or Battery Storage system, it is treated as a related product under RECC. Standalone EV charge point installs may instead fall under the Electric Vehicle Consumer Code (EVCC) and Green Homes Dispute Resolution. We will confirm the applicable consumer code and complaints route in your quotation.
Part D: Paying with finance
This part applies to all customers, domestic and commercial.
D1. Our status
Hybrid Energy Limited is not a lender or a credit broker, and is not authorised or regulated by the Financial Conduct Authority (FCA). We do not arrange, recommend or advise on finance, and we cannot help you choose between finance products.
OpenSolar's help centre states that OpenSolar acts as the introducing representative for Selina Finance. OpenSolar Pty Ltd (Australia) operates the platform. Direct any finance product questions to the relevant lender.
D2. How finance works
- Finance options shown in our proposals are offered by third-party lenders through the OpenSolar Finance Marketplace. If you choose to apply, you apply and deal directly with the lender.
- Any finance agreement is between you and the lender, on the lender's own terms, and is subject to status. The lender decides whether to offer you finance and on what terms.
- Finance is optional. You can always pay by other means, and our price for your system does not change whichever way you pay.
- We do not discuss your application or the lender's decision, and we will not follow up on incomplete applications. If you have any question about finance, an application or a decision, please contact the lender directly.
- Information you enter into a finance application goes directly to the lender and is handled under the lender's own privacy notice. See our Privacy Policy at www.hybridenergyltd.co.uk/privacy-policy.
D3. The lenders
Selina Finance Limited (FCA firm reference number 820183), for residential customers. Selina's finance is a loan secured on your home.
YOUR HOME MAY BE REPOSSESSED IF YOU DO NOT KEEP UP REPAYMENTS ON A MORTGAGE OR ANY OTHER DEBT SECURED ON IT.
Propensio Finance Limited (FCA firm reference number 806409), for residential customers. Propensio's finance is unsecured.
Smart Ease (Energy Lease Limited, company number 13995435, trading as Smart Ease), for commercial customers only (businesses, schools and other organisations). Smart Ease's published materials describe commercial payment plans (loan, rental and solar PPA). Business finance to limited companies is typically unregulated; some lending to sole traders, small partnerships or unincorporated associations can still be regulated consumer credit.
D4. Complaints about finance
If your complaint is about a finance agreement or the lender, please contact the lender first. If you are not satisfied with the lender's response, you may be able to refer your complaint to the Financial Ombudsman Service. Complaints about your installation should be made to us under our Complaints Procedure at www.hybridenergyltd.co.uk/complaint-policy.
Part E: Commercial customers
If you are buying for business purposes, the consumer terms in Part C do not apply. Commercial projects are carried out under our separate commercial terms and conditions, which we will provide with your quotation (available on request). Small businesses that meet RECC's definition of a "micro-business consumer" may have access to an independent arbitration scheme. See our Complaints Procedure.
Part F: Changes to these terms
We may update this page from time to time. The terms that apply to your project are the ones in your contract when you sign it.
